PIANO STREET - TERMS AND CONDITIONS

This legal document describes the rights and obligations of "Piano Street" (Op 111 Productions) and the "Subscriber".
Some parts are also applicable to free downloads where appropriate.

Piano Street's Rights & Obligations
1. Piano Street will offer Subscriber sheet music and sound files via direct download. All files to be provided in generally accepted standard file formats (pdf, audio etc.). Delivery via email or conventional mail, either in print or other graphical formats, is not available.
2. Piano Street guarantees that Subscriber will receive assistance in matters concerning access to the provided content. Piano Street declines to accept any responsibility, in any form, for any damages and losses incurred by Subscriber.
3. Piano Street is not responsible for any problems related to Subscriber's Internet connection, web browser and other software and hardware used before, during and after a site browsing session or a file download operation. In no case Piano Street shall reimburse Subscriber for a purchase already made because of such problems.
4. Piano Street is not responsible for Subscriber's intended and/or actual usage of all purchased sheet music and whether such usage causes harm to any third party or violate any national or international copyright laws.
5. Piano Street is not responsible for any malfunctioning and/or poor performance of it's web site. In such cases, Piano Street, upon notification from Subscriber or visitor, agrees to take the necessary steps to attempt to resolve the problem(s).
6.Piano Street will make reasonable efforts to keep your account and the services operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. We will make reasonable efforts to notify you at least twenty-four (24) hours in advance of any downtime that we anticipate in advance will exceed one hour.
7. Piano Street also reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any content and features of the services with or without notice.
8. Piano Street shall not be liable to you or to any third party for any of the direct or indirect consequences of any modification, malfunction, suspension, discontinuance of or interruption to or of any of the services.
9. Piano Street is not obligated to issue a refund if Subscriber is not satisfied with the content or service offered. However, refund will be given within the "money back guarantee" time limit and can be given at the company's discretion outside this time limit.
10. Piano Street is not responsible for any problem(s) and/or complaints arising from payment processing, which is done via Pay Pal or World Pay.
11. Piano Street declares to adopt privacy rules conform to Online Privacy Alliance guidelines in order to preserve his Subscriber's privacy. See our Privacy Statement for more information.
12. Piano Street has the right to terminate the subscription if subscriber is sharing username/password with any third party. (ip-addresses are logged)

TECHNOLOGY LIMITATIONS AND MODIFICATIONS TO SERVICE
1. Piano Street will make reasonable efforts to keep your account and the services operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. Subscriber's Rights & Obligations
1. Subscriber shall not hold Piano Street liable for any matters outside of its sphere of responsibility, and in any case outside of the scope of this web site.
2. Subscriber agrees to read and abide by the regulations about copyrights and License Agreement, as outlined in this legal document.
3. Subscriber shall not hold Piano Street responsible for any malfunctioning of this web site, for lack of satisfaction with his subscription, or any other matter resulting from a transaction made via this web site.
4. Subscriber acknowledges the fact the Piano Street cannot and will not deliver any content via email or conventional mail, neither in printed format nor in other formats.
5. Subscriber understands that any content of the paid service will be made available for download only following payment made through PayPal or WorldPay.
6. Subscriber is aware of Paragraph 3 as described earlier in the "Piano Street's Rights & Obligations" section relative to problems resulting from Subscriber's Internet connection, hardware & software used during browsing and download, etc.
7. Subscriber agrees not to divulge, publish on the web, or sell to third parties any music obtained, nor let any third party make use of subscribers username/password, without Piano Street's prior consent.
8. The Piano Street site is subject to copyright law in the US only. However, when you print the music out, its legality is then subject to the law in your country. We cannot take responsibility for any infringements of copyright law instigated in this manner.
9. Subscriber unconditionally accepts the contents of this document, both before and after a subscription.

Copyrights
1. Piano Street distributes classical piano music. Excluded are those composers who have their own copyrights, or whose copyrights are held and protected by Editors, Associations, Institutions and Heirs.
2. In no case Piano Street can make available for download any sheet music whose copyrights are currently exclusively held by others.
3. Subscriber agrees not to violate any copyrights that Piano Street has on all distributed documents or sound files and on the website. All duplication, reproduction, sale and advertising of the aforementioned documents is strictly forbidden without prior consent from Piano Street.
4. Subscriber agrees to respect the terms of the following "License Agreement".

Piano Street PDF-scores and sound files - License Agreement
Carefully read all the terms and conditions of this license agreement prior to downloading your files. The download of all or any portion of our music indicates your agreement to the following terms and conditions and the above Legal Document.
Piano Street grants you, the Subscriber, a non-exclusive license to use the provided files under the terms and conditions stated in this agreement.

You may:
1. make one copy of the PDF score or sound file solely for back-up purposes.
2. print the PDF score for your personal purposes including performances, musical teaching (not including making copies to students), personal study, etc.
You may not:
1. distribute copies of the PDF scores, audio files or any other content in whole or in part except as expressly provided for in this agreement.
2. make alterations or modifications to the PDF score or any copy, or otherwise attempt to discover the source code of the PDF score.
3. sub-license, lease, lend, sell, rent or grant others any rights, or provide copies to others (this is applied even, and above all, to musical content).
4. utilize the musical content (copyright protected) for different purposes than above mentioned (allowed are: personal performances, study and teaching). Piano Street has "All Copyrights Reserved" on all the scores on this site.

Termination:
This agreement is effective until terminated. You may terminate it at any time by destroying the PDF score or audio file together with all copies in any form. It will also terminate if you fail to comply with any term or condition in this agreement.

You agree, through your use of this forum, that you will not post any material which is false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, adult material, or otherwise in violation of any International or United States Federal law. You also agree not to post any copyrighted material unless you own the copyright or you have written consent from the owner of the copyrighted material. Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are also forbidden on this forum.
