Let me answer your question with a question. Is it legal to record a movie that is being shown on TV, convert it to mpg and then distribute it on the web?

Hint: The answer is NO.

The true question is, does it matter

It all depends on how you view theft. If you think it's Ok for someone to take something of yours and give it to other people without permission then sharing copyright material on the web shouldn't bother you. It's sad how people who understand laws that apply to tangible goods think that they don't (or even shouldn't) apply to intangible goods or intellectual property.

You don't get thrown in jail for committing any kind of theft - tangible property or intellectual property - unless you also get caught, tried in a court of law and found guilty.

Agreed. I was pointing out that just because you haven't been caught doesn't mean you haven't committed a crime. I want to make the point clear- file sharing copyrighted material IS a crime. I thought some of the stories I heard were just scare tactics until a work colleague told me his friend is being prosecuted for doing it. Ignorance of the law is NO excuse. File sharing copyright material is a crime.

people in UK have been sued for huge amounts for downloading off P2P. they could do this to many more, but they choose to use this as an example to others, rather than as a new enforcement.
