Should I repeat the f sharp under the slur in bar 38?

i would. i would just finger legato for the top note and explore using a different finger for the repeated f sharp ie
4 -> 5
2 -> 1

Personally, I would play the repeat the f-sharp as it is written this way, so presumably the composer of this piece would want it to sound that way. It has quite a different effect if you don't play it. With regards to how you play the slur, in my opinion, the timing of the release of both notes has to be the same so that is a slightly elongated first note to indicate a slur followed by a swift detached second note. Whether you want to change the fingers is up to you, I would probably just play 3-1 4-1 and work on the articulation so as to get the release of the first note as close as possible to the next note whilst there still being an audible change.
