Can we post brief clips of pro recordings?
on: March 22, 2011, 03:34:21 AM
After the Becky-LadyPianist-Roger person/people posted clips I was wondering about that again.

Can we post short clips from actual professional recordings Nils?  I was thinking about a "Name that tune" type of thread.  I'm not sure if it violates copyright laws.  I'm pretty sure the B-LP-R member(s) did though with what they posted.

It already happens in the YouTube threads. Just saying.

Just to chip in a little, it would not be a violation of copyright laws (not sure in the different jurisdictions actually, but this is the law adopted in most common law jurisdictions) provided there was not a "substantial part" of the recording.

I am quite certain that posting some clip which is like 5-10 seconds long would not violate copyright laws.
Bach - Partita No.2
Scriabin - Etude 8/12
Debussy - L'isle Joyeuse
Liszt - Un Sospiro

Goal:
Prokofiev - Toccata

Also, anyone care to comment on what exactly happened with Becky and all those people? I missed out on that.

In a nutshell - it was discovered that the recordings they posted were actually taken from other peoples youtube videos and claimed to be their own. I twigged on, after they pieces that were being uploaded so frequently were far too difficult to have been learned in such a short time frame.

All 3 usernames were created by the same person, but their recordings were fraudulent.

The simple answer to Bob's question is that posting copyrighted recordings without having proper permission does violate copyright laws and that would be the case if you take for example a clip from a CD and upload it here. The lengt of the clip would not matter.
What  invictious is reffering to is called "fair use" or "fair dealing" which is a somewhat gray area. Read more about "fair use" here:

Is it post at your own risk?

If the purpose of the clip is for non-profit educational use...
then it falls into the "fair use" category. I would surmise that
posting a clip for comments on style, interpretation and demonstration
in a pianist's forum like Pianostreet where a good proportion of
discussions are derived from teachers and students would safely fall into
fair use.

Piano Street would be 'for profit' I think.  At least as a business.  The poster wouldn't be expecting to make any more off the recording clip.

And the audience would be the whole world.

I'm still thinking it's fair use though.  But I'm thinking about ten second clips.

I remember 10 inch discs (well, I remember that they once existed, anyway) but, since neither the far more widely manufactured 12 inch LP, the 5 inch CD or any of the other commercially available recorded media types have yet sported 15 inches (at least to my knowledge), I cannot help but wonder about the significance of the above assertion, although maybe some enlightenment on this might be forthcoming...
